미국변호사시험/캘리포니아바시험 - Notice pleading과 Code pleading 비

 

미국 로스쿨에서 다루는 Civil procedure는 주로 Federal courts기준으로 배우게 됩니다. 미국 변호사시험을 UBE로 치룬다면 Federal 기준만 알고 있더라도 문제는 없습니다. 하지만 UBE가 아닌 곳에서 시험을 치르고자한다면 그 State 시험 범위를 확인할 필요가 있습니다. 대표적인 곳이 California 캘리포니아 입니다.

 

Pleading의 종류는 크게 두개로 나눌 수 있습니다. Notice pleading과 Code pleading입니다.

 

1. Notice pleading - Federal courts

Notice pleading은 Federal Rules of Civil Procedure (FRCP)에 적용되는 규칙입니다.

 

원칙상 소장에 Claim에 대한 "Short and plain statement"를 적으면 됩니다. 그리고 Plausible수준으로 사실관계를 적으면 문제는 없습니다. 소장 자체의 목적이 Defendant에게 Claim 고지를 하는 것이기 때문입니다.

 

대신 소송의 종류에 따라 With particularity요건에 따라 구체적인 사실관계를 요구하고 있습니다. 대표적으로 Fraud소송이 해당됩니다.

 

2. Code ple

ading - California State Courts

한편, Code pleading은 State code에 따라 규정된 규칙을 따라야 합니다. 앞서 설명과 달리 All material facts for each element required를 소장에 적어야 합니다. 만약 Claims를 Neglience, product liability로 두개를 건다고 하면 두개 중 한개는 반드시 모든 요건을 소장에 모두 증명해야 합니다. 예를 들어, Negligence의 요건 전부 또는 Product liability요건 전부를 증명해야 합니다.

 

Claim의 요건을 사실에 기반하여 모두 증명하는 것을 목표로 두고 있습니다. 그렇기 때문에 처음부터 소장에 요구되는 사항은 Specific, detailed facts of each element를 요구합니다.

 

따라서, 연방민사소송법상으로는 문제가 없는 Complaint 소장인데 캘리포니아소송법상으로 문제가 있는 Complaint로 간주될 수 있습니다. 이처럼 같은 Complaint라고 할지라도 다른 결과가 나올 수 있습니다.

 

캘리포니아주 민사소송법은 Initial disclosure자체도 FRCP연방 민사소송법과 차이가 있습니다. 아무래도 Choice of law에 신경을 써야하는 부분이 생긴다고 보면 됩니다.

 

 

주요한 차이는 아래와 같다고 보면 됩니다. 그 중에 "pleading standard"를 확인해보았습니다.
