[미국변호사시험자격] Bar admission요건 스스로 확인해보기 (feat. NCBE, 법원)

 

한국에서 제공하고 있는 미국변호사 시험 준비 프로그램들이 여러가지가 있습니다. 그리고 한국 변호사님, 변리사님, 노무사님, 세무사님, 회계사님 등 전문직 종사자 분들께서 관심 갖는 Jurisdiction이 있습니다. 그래서 어떤 방식으로 자격요건을 확인할 수 있는지 정리를 해보았습니다.

 

1. NCBE에서 정리한 NCBE Comprehensive Guide to Bar Admission Requirements

NCBE에서 바시험에 대한 정보를 정리하고 있습니다. 웹사이트를 잘 뒤져보면 나오는데 사실 잘 찾아내기가 어렵습니다. 과거에는 책자 형식으로 나와서 보기도 편하고 검색도 편했었는데 어느 순간 바뀐 다음부터는 찾기가 어려워 졌습니다.

위에 1번 제목을 구글에서 검색을 하면 웹사이트를 확인할 수 있습니다. 해당 웹사이트에 들어가면 위와 같은 화면을 볼 수 있습니다. 시험에 관련된 여러 정보들을 확인할 수 있습니다. UBE Jurisdiction, Non-UBE jurisidction, MPRE requirement 등 여러 정보를 한눈에 볼 수 있습니다. 아무래도 바시험에 대한 전체적인 윤곽을 보고자 한다면 이 자료를 보는 것도 의미가 있을 것 같습니다.

 

2. Foreign Legal Education관련 설명

아무래도 Domestic Legal Education은 미국 현지인이 관심을 가질 사항이라고 생각합니다. 대부분의 한국분들 또는 미국인이 아닌 사람들이 관심을 갖는 항목이 바로 Foreign Legal Education입니다. 이 항목을 보게 되면 표로 정리된 자료를 볼 수 있습니다.

위 정보를 확인하면 한국인들이 관심을 갖고 있는 1)워싱턴 DC바, 2)캘리포니아바, 3)일리노이바, 4)뉴욕바 요건을 볼 수 있습니다. 다만 구체적인 요건을 확인하기는 어렵습니다. 적어도 어떤 제도를 갖고 있는지 정도는 확인할 수 있습니다.

 

위 자료를 훑어보면 Common law jurisdiction에 대한 신뢰를 엿볼 수 있습니다. Common law기반인 곳에서 교육을 받았거나 변호사 활동을 한 사람들에게 더 낮은 허들을 제공하는 것을 볼 수 있습니다.

 

3. 법원 사이트에서 요건을 확인하기 또는 법원에 문의하기

본인이 관심있는 Jurisdiction을 찾았다고 가정을 해봅시다. 구체적인 Rule은 법원에 들어가서 확인을 하는 것이 좋습니다.

 

예를 들어, 워싱턴 DC 법원에 들어가면 Admission to the bar관련 Rule을 확인할 수 있습니다. Rule을 보면서 본인에게 해당되는 요건인지 확인할 수 있습니다.

아무래도 시험 지원시 첨부해야하는 서류 때문에 궁금증이 생길 수 있습니다. 시험에 대한 자격 요건은 법원에서 직접 관리하기 때문에 법원에 물어보는 것이 좋습니다. 법원마다 답변을 해주는 경우도 있고 해주지 않는 경우도 있습니다. 아무래도 외국인이 많이 지원하는 법원일수록 답변을 해주지 않는 경우가 많습니다. 그래서 "지원을 하면 결과를 알려줄게"라는 느낌이 듭니다. 법원의 방침이기 때문에 이 부분은 지원자가 어떻게 할 수 있는 것은 아닌 것 같습니다. 특정 Jurisdiction에 한국인 수험생이 많은 이유가 있는 이유가 있다는 것을 위 내용을 통해 알 수 있었을 것이라고 생각합니다.

 

결국, 법원에서 시험 자격 요건에 대해 최종판단을 하고 있습니다. 이런 이유 때문에 저는 미국변호사 시험 자격에 대해서는 따로 질의문답을 받고 있지는 않습니다. 그렇지만 자격요건에 대해 관심을 갖고 있는 분들에게 직접 요건을 찾는 방법에 대해 소개를 드리고 싶어서 정리했습니다.
