미국 변호사 시험 - MBE 과목별 문제풀이 모음 패키지 (Package) 오픈

이번 포스팅은 "미국 변호사 시험 MBE 이론 강의"에 이어 "MBE 과목별 문제 풀이 강의"를 소개하고자 합니다.

 

미국 변호사 시험을 준비하시는 분들을 가르치면서 "필요한 개념" 과 "혼동하기 쉬운 개념"을 파악할 수

있었습니다. 시험 문제에서도 반드시 나오는 개념이 있기 때문에 이 부분에 대한 명확한 이해가 필요합니다. 하지만, 정확한 이해를 할 수 있는 강의나 책을 구하기 어렵고 스스로 터득하기에 많은 에너지와 노력이 든다고 파악을 했습니다. 그래서, 이를 해결하기 위해 "본격 미국법 파헤치기 시리즈"와 "미국 변호사 시험 - MBE이론 강의"를 열었습니다.

 

이론 강의를 열고 난 이후, "직접 문제를 어떻게 접근해야 하는지", "특정 개념을 문제에서 어떻게 구분할 수 있는지" 보여드리고 싶었습니다. Barbri, Themis, Kaplan, S&T등 여러 종류의 문제집이 있지만, 제가 직접 문제를 설계하고 싶었습니다. 왜냐하면, 이미 시험 문제에 노출된 수험생이 많을 뿐만 아니라 "익숙한 예제"에서 어떻게 정답이 "변경"되는지 보여드리고 싶었습니다. 그래서, 문제와 더불어 해설 강의를 찍게 되었습니다. 특별히, 어려운 개념, 실수하기 쉬운 개념을 위주로 문제를 구성해 보았습니다.

*Contract에서 실수를 할 만한 개념을 다루려고 했습니다. Offer과 Acceptance의 시점을 잡아보는 훈련, 교차 청약의 경우 미국에서는 계약으로 인정되지 않는 점 등을 설명하고자 했습니다. Damage 계산에 약한 분들이라면 충분히 극복할 수 있도록 문제를 설계했습니다.

*Criminal law에서 Common law와 MPC를 나누는 것이 매우 중요합니다. 그리고 범행 Elements를 파악하는 것도 시험에 자주 등장하는 부분입니다. 이 부분을 체계적으로 다루었습니다. 그리고 Criminal procedure에 심혈을 기울였습니다. Criminal procedure는 일반적인 수험생의 경우 익숙하지 않습니다. 한국 형사소송법과 미국 형사소송법 사이에 간극이 꽤 있습니다. Arrest warrant에 대한 이해가 다릅니다. 이 부분을 이해하기 쉽도록 문제를 설계했고 설명했습니다.

*Federal Rule of Civil Procedure은 절차법으로 절차만 알면 문제 풀기가 쉽습니다. 일반적인 문제집은 Personal jurisdictin, Subject matter jurisdiction, Supplemental jurisdiction을 다룹니다. 제가 설계한 문제는 이 부분 뿐만 아니라 Trial process를 좀 더 깊게 다루고 있습니다. Initial disclosure, Discovery, Interrogation, Deposition 등이 포함되어 있습니다. 예상 못한 문제가 나올 때, 극복할 수 있도록 설명을 녹여 보았습니다.

미국 변호사 시험을 준비하면서 의외로 합격률이 낮다는 점에 낙심하는 경우가 있습니다. 바시험에 대해 어떤 사람은 "쉽다"라고 주장하는 경우도 있고 다른 사람은 "어렵다"라고 주장하기도 합니다. 어렵고 쉽다는 기준은 개인마다 다르기 때문에 이 부분은 제가 설명하기 어렵습니다. 다만, 워싱턴 DC 외국인 합격률, 뉴욕바 외국인 합격률, 캘바 외국인 합격률을 확인해 보신다면, 어느 정도 감을 잡을 수 있다고 생각합니다.
